# Terms of Service

Effective date: October 11, 2026

These Terms are a binding agreement between you and Sentium Inc., a Delaware corporation, 1111B S Governors Ave, STE 39446, Dover, DE 19904, USA ("Sentium", "we", "us"). Sentium operates BEATKING: the game at play.beatking.win, the website at beatking.win, the BEATKING Android app, the BEATKING Telegram bot, and related websites and services (together, the "Game").

**Please read Section 20. It requires most disputes to be resolved by individual binding arbitration, not in court, and waives class actions. You can opt out within 30 days (Section 20.7).**

## 1. Acceptance

1.1. When you first sign in, the Game asks you to confirm that you are 18 or older, that you are not in a blocked country, and that you agree to these Terms and the Privacy Policy. We record the version you accepted and when. You also accept these Terms, as updated under Section 21, whenever you access or use the Game. If you do not accept them, do not use the Game.

1.2. Our Privacy Policy at beatking.win/privacy explains how we handle personal data. It forms part of these Terms.

1.3. The player docs (the "Docs") explain how the Game works. They are information, not promises. If the Docs and these Terms disagree, these Terms win.

## 2. Eligibility

2.1. You may use the Game only if all of the following are true:

* (a) you are at least 18 years old and at least the age of majority where you live;
* (b) you can enter into a binding contract;
* (c) you are not a person named on, or owned or controlled by a person named on, any sanctions list kept by the United States (including OFAC), the United Nations, the European Union or the United Kingdom;
* (d) you are not located in, ordinarily resident in, or organised in a country or region listed in Section 2.3 (the "Restricted Jurisdictions");
* (e) your use of the Game, including minting and trading items, is lawful where you are.

2.2. Laws on games of chance, loot boxes, prize promotions, digital assets and taxes differ by country and change over time. You alone are responsible for knowing and following the laws that apply to you. If the law where you are prohibits paid random rewards, or the purchase or trade of digital assets, do not mint or trade items.

2.3. **Restricted Jurisdictions.** The Game is not available in: Cuba, Iran, North Korea, Syria, the Crimea, Donetsk and Luhansk regions, Russia, Belgium and the Netherlands. We may change this list at any time, and we may block access from these and any other places.

2.4. You must not use the Game from a Restricted Jurisdiction, or use a VPN, proxy or any other method to hide your location or to get around a block. If you do, we may remove your rewards and items from Game use and close your account, as described in Section 5.4.

2.5. We may restrict or block access from any place, at any time, for any reason, including legal or regulatory caution. We may ask you to confirm your age or location, and we may screen wallet addresses, but we are not obliged to.

2.6. **Access.** Access to the Game is by invitation. Signing in places you on a waitlist and does not entitle you to access. You need an invite code, or another form of access Sentium grants, to use the Game. Sentium may grant, refuse, limit, suspend or revoke access, and issue, cancel or invalidate invite codes, at any time, in its sole discretion and without giving reasons. Invite codes have no monetary value. You may give an invite code to another person for free. You must not sell or trade it, or offer it for anything of value.

## 3. Your account

3.1. You sign in with Telegram or with a Solana wallet. Your use of Telegram and your wallet is governed by their own terms.

3.2. One person, one account. You must not create, run, buy, sell, rent, share or control more than one account, or let anyone else use yours.

3.3. You are responsible for everything done through your account, your Telegram account and your wallets. Keep them secure. Tell us at <support@beatking.win> at once if you think someone else has used your account.

3.4. Your username must not impersonate anyone, infringe anyone's rights, or be offensive or misleading. We may change or remove a username.

3.5. Accounts are never merged. If a Telegram account or wallet is already linked to another account, it cannot be linked to yours.

3.6. Your account is personal. It is not property, and it cannot be sold or transferred.

## 4. Wallets

4.1. **Your own wallet.** In the Android app, and in a browser on a computer, you can connect your own Solana wallet. You hold its keys. Sentium never holds or sees them and cannot recover them.

4.2. **Hosted wallet.** If you have no wallet of your own, the Game can create a hosted wallet for you through Privy, a third-party wallet provider. The wallet is created for your Telegram identity and is subject to Privy's terms. Sentium does not store its private key. Sentium's server key is an additional signer on the wallet and can sign transactions from it without a separate signature from you. The Game uses it for actions you take in the Game, such as paying for a mint, listing, buying or delisting an item on the market, enabling a power-up for play, and withdrawals that you approve in the BEATKING Telegram bot to an address you give. Check the address before you approve: a withdrawal cannot be reversed. A small amount of SOL stays in the hosted wallet to pay network fees.

4.3. If you lose access to your Telegram account, you may lose control of your hosted wallet and what it holds. Sentium is not responsible for that loss.

4.4. Sentium is not a bank, custodian, exchange, broker or money transmitter. We do not take deposits or hold your funds for you, and we do not exchange SOL for other currencies.

4.5. Before you delete your account, move your SOL and items out of the hosted wallet with Withdraw. The Game cannot delete your account while the hosted wallet holds items or more than the small fee reserve, or while a withdrawal is in progress.

## 5. Playing and fair play

5.1. **Only the server's result counts.** Every run is recorded on your phone and sent to our servers, which score it again from the recorded input. A run counts only if our servers verify it. Our decision on whether a run counts, what it scores and what rewards it gives is final, except as required by law.

5.2. **Phones only.** The Game is played with your thumbs on a phone. Runs from desktop computers, emulators or anything other than real touches on a phone do not count. On iPhone, the Game needs permission to read device motion before you can play.

5.3. **Prohibited.** You must not, and must not help or allow anyone else to:

* (a) use bots, scripts, macros, autoclickers, emulators, automation, or any hardware or software that plays or taps for you or helps you tap;
* (b) use AI tools or agents to play, generate input, or create, edit, replay or submit run data;
* (c) fake, alter, copy, replay or tamper with run logs, network traffic or the Game's code;
* (d) take advantage of bugs, errors or design flaws to gain rewards, items or advantages, instead of reporting them to us;
* (e) operate multiple accounts, or farm rewards with several accounts or devices;
* (f) reverse engineer, decompile, scrape, overload, disrupt or misuse the Game or its servers, or try to get past any security, verification or limit;
* (g) buy, sell or transfer accounts, crowns, gems or locked items, or sell or trade invite codes;
* (h) use the Game for fraud, money laundering, sanctions evasion or any other unlawful purpose;
* (i) harass others, or upload or display unlawful, infringing or offensive content.

5.4. **Enforcement.** If we believe, in our sole discretion, that you or your account broke these Terms, or if we need to protect the Game, other players or Sentium, we may, without notice and without compensation:

* (a) refuse to count runs, and withhold, remove or reverse crowns, gems, drops, mints and other rewards, including rewards already credited;
* (b) block minting, listing, sends and other features of your account, for a time or for good;
* (c) stop any item from being used in the Game, and use the item authorities described in Section 6.5;
* (d) remove you from leaderboards and seasons;
* (e) suspend, close or delete your account and any linked accounts;
* (f) report activity to authorities where we think it is appropriate or required.

5.5. We use automated systems to check runs and accounts. We do not disclose how they work, what they look for or why a particular run or account was flagged. We are not required to explain a decision, except where the law requires it.

5.6. Rewards credited by mistake, through a bug or through a server error may be corrected or reversed.

## 6. Items, crowns, gems and other game content

6.1. **Game content.** The Game contains crowns, gems, invite codes, devices, power-ups, studio passes and other content. Some items are tokens on the Solana blockchain ("NFT Items"). Others exist only in our database ("Locked Items"), for example the training device. The Game shows which items are locked.

6.2. **Crowns, gems and invite codes.** Crowns (season standing), gems (earned by runs and spent on mints) and invite codes are records on your account. They:

* (a) have no monetary value and are not money, currency, securities, property or a claim against Sentium;
* (b) cannot be sold, transferred, exchanged or redeemed for cash, crypto or anything else, except gems for minting inside the Game, and except that you may give invite codes away for free;
* (c) give you no right to any future reward, payment, asset or benefit of any kind;
* (d) are not a promise of or a right to any token, airdrop, allocation or distribution. If Sentium ever offers such a program, it will have its own terms, and Sentium alone decides whether and how crowns count.

We may change, reset, expire or remove crowns, gems, invite codes and seasons at any time, including at the end of a season, for any reason.

6.3. **Locked Items** are a limited licence to use the item in the Game while your account is active. You do not own them. They cannot be sold or sent, and they end when your account ends.

6.4. **NFT Items.** When an NFT Item is in your wallet, you control that token on the blockchain. You do not own any copyright, trademark or other intellectual property in it, its art, name or music. Sentium grants you a limited, worldwide, non-exclusive licence to display the item's art for personal, non-commercial purposes while you hold the token. It ends when you no longer hold it.

6.5. **How items work.** Items depend on our servers and our rules. Please understand:

* (a) an item's stats, battery, lifespan and state are stored by Sentium, not in the token, and Sentium decides them;
* (b) devices wear out: battery runs down and recharges, life does not come back, and a device at zero life is used up for good, though its token stays in your wallet;
* (c) a fired power-up is used up, and if it is an NFT Item its token is burned;
* (d) items are created with authorities that let Sentium update their names, images and metadata, mark them used up, and for some items freeze or burn them, without your signature. Sentium uses these authorities to run the Game and enforce these Terms;
* (e) a power-up that has left your wallet and come back, or whose delegate has changed, must be enabled again before it can be played, and you pay the network fee;
* (f) we may change items, stats, rarities, drop chances, rewards, prices and any other part of the Game at any time, including in ways that reduce an item's usefulness or value;
* (g) an item works only in the Game, and only for as long as the Game supports it. If the Game ends, items may have no use at all.

## 7. Minting and other purchases

7.1. **Random results.** Minting gives you an item chosen at random, such as a device, a studio pass or other items. Which items can result, their attributes and their chances are determined by Sentium in its sole discretion and may change at any time without notice. Any odds shown in the Game or the Docs are approximate, are for information only, and do not guarantee any result over any number of mints.

7.2. **Prices and payment.** Minting and other purchases cost what the Game shows at the time, which may include gems and a fee in SOL, SKR or other tokens on the Solana blockchain that the Game accepts. Sentium may set, change or withdraw prices, accepted tokens and payment options at any time.

7.3. **Limited sales.** Sentium may offer items for sale from time to time, including in limited quantities, for a limited time or with limits per account. Sentium may change, pause or end any sale at any time.

7.4. **All sales are final.** Once your payment is confirmed on the blockchain, the mint or purchase is complete. There are no refunds, returns, exchanges or buybacks, and Sentium does not buy items back, except where the law requires it.

7.5. **Immediate delivery.** Before you pay, the Game tells you that delivery is immediate and cannot be cancelled. By confirming, you ask us to deliver immediately. Where the law gives you a right to withdraw from a purchase of digital content, you agree that delivery starts at once and that you lose that right once delivery begins.

7.6. **Failed delivery.** If you paid and did not receive what you paid for, write to <support@beatking.win> with your wallet address and the transaction. If we confirm that your payment reached us and the item was not delivered, we will, at our choice, deliver it or return what you paid, less network fees. This is your only remedy for a failed delivery.

7.7. **Markets.** The Game may let you list, buy and sell items through third-party marketplace programs, such as Tensor's. Those trades are between players, run on the blockchain under the third party's rules, and Sentium is not a party to them, does not hold your items or funds, and is not responsible for them. Fees, including a creator fee to Sentium, may apply. Sentium may limit, pause or stop any market feature at any time.

7.8. **Fees.** You pay all network fees for transactions you sign. Marketplaces and wallet providers may charge their own fees. Sentium may charge fees on purchases and trades, including creator fees on secondary sales.

7.9. **Taxes.** You are responsible for any taxes on your purchases, sales, trades and rewards.

## 8. Not an investment

8.1. Items, mints and rewards are entertainment and game content. They are not investments. Do not mint or buy items expecting a profit.

8.2. Sentium makes no promise that you will earn anything, that any item will have or keep any value, that there will be a market for any item, or that you can sell anything. Item prices are set by other players on third-party marketplaces and can fall to zero.

8.3. Sentium does not give financial, investment, legal or tax advice. Nothing in the Game, the Docs or our posts is such advice.

8.4. Only spend what you can afford to lose. If you feel your spending is out of control, stop playing and seek help.

8.5. Sentium has not issued a token. Nothing in the Game, the Docs or our posts is an offer or a promise of one.

## 9. Blockchain risks

You understand and accept these risks:

* (a) blockchain transactions cannot be reversed. A transaction sent to the wrong address, or signed by mistake, is lost;
* (b) network fees vary, and transactions can fail, be delayed or land late;
* (c) Solana, its programs, validators, RPC providers and indexers may fail, change, fork, slow down or stop;
* (d) wallets, private keys and accounts can be lost, stolen or hacked. Anyone with your keys or your Telegram account may be able to take your assets;
* (e) smart contracts, wallets, marketplaces and our own systems may contain bugs or be misused or compromised;
* (f) laws on digital assets may change and may affect the Game, items or your ability to use them;
* (g) SOL and item prices are volatile.

Sentium is not responsible for any of these risks or any loss they cause, to the fullest extent allowed by law.

## 10. Third-party services

10.1. The Game relies on services Sentium does not control, including Telegram, Privy, Solana Mobile, the Solana network, wallet apps, NFT marketplaces such as Tensor, and our hosting and network providers. Their own terms and privacy policies apply to your use of them.

10.2. Sentium is not responsible for third-party services, their availability, fees, security, actions or failures, or for any trade you make on a marketplace.

## 11. The Android app and app stores

11.1. The BEATKING Android app loads the live Game. Updates to the Game may reach the app without a new download.

11.2. If you get the app through the Solana Mobile dApp Store, the dApp Store's own terms apply between you and Solana Mobile. They apply to Sentium only as far as Solana Mobile's publisher rules require. Solana Mobile is not a party to these Terms and is not responsible for the Game, its content, its support or any claim about it. Apple and Google are not parties to these Terms, and their app store terms do not apply to the Game.

## 12. Availability, pauses and changes

12.1. The Game is provided as it is from time to time. We do not promise it will be available, error-free or secure, and we offer no service level.

12.2. We may pause, limit or stop any part of the Game at any time and without notice, including rewards, minting, the market, sends, sign-in, seasons, leaderboards or the whole Game.

12.3. We may change any part of the Game at any time, including scoring, rewards, prices, items, seasons and rules.

## 13. Our content and licence to you

13.1. Sentium and its licensors own the Game and everything in it: software, charts, songs, art, item designs, names, logos and trademarks, including BEATKING.

13.2. Songs in the Game include music created with AI tools. Sentium grants you a limited, personal, non-exclusive, non-transferable, revocable licence to play the Game and listen to its songs inside the Game for your own non-commercial entertainment.

13.3. You may share screenshots, short clips and score cards of your own play, for non-commercial purposes, as long as you do not suggest Sentium endorses you. We may withdraw this permission at any time.

13.4. You must not copy, extract, record for redistribution, sell, sublicense or create derivative works from the Game or its songs, charts or art, except as these Terms allow.

13.5. If you send us feedback or ideas, we may use them freely, without paying you.

## 14. Content you create

14.1. The Game may let you create songs and other content, including prompts, lyrics, titles, usernames and other material ("Your Content").

14.2. You must have all rights needed for Your Content. It must not infringe anyone's rights, imitate real artists in a misleading way, or contain unlawful, hateful, sexual or otherwise harmful material.

14.3. You grant Sentium a worldwide, perpetual, irrevocable, royalty-free, transferable and sublicensable licence to use, host, copy, modify, adapt, publish, perform, distribute and display Your Content, in any media, to operate, improve and promote the Game and Sentium.

14.4. Songs created in the Game are generated by third-party AI services from your input. As between you and Sentium, Sentium holds any rights in songs and covers generated in the Game. Sentium grants you a licence to share them for non-commercial purposes. AI output may not be protected by copyright and may resemble other works. Sentium gives no promise about it.

14.5. Sentium may review, refuse, edit, remove or stop showing any content at any time, for any reason. Rewards linked to content we remove may be withheld or reversed.

14.6. To report content you believe infringes your rights, write to <support@beatking.win> with the content, your rights in it and your contact details.

## 15. Ending your use

15.1. You can stop using the Game at any time and can delete your account in the Game. Deleting your account ends your crowns, gems, invite codes and Locked Items for good. NFT Items in your own wallet stay there.

15.2. We may suspend or end your access at any time, with or without notice, for any reason, including a breach of these Terms or if we stop the Game.

15.3. Sections 6.2, 6.5, 7.4, 8, 9, 10, 13.5, 14, 16 to 21 and any other terms that by their nature should survive will survive the end of these Terms.

## 16. Disclaimers

THE GAME, ITEMS AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT ALLOWED BY LAW, SENTIUM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE. SENTIUM DOES NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, THAT RUNS WILL BE JUDGED WITHOUT ERROR, OR THAT ANY ITEM WILL HAVE ANY VALUE OR UTILITY.

## 17. Limitation of liability

17.1. TO THE FULLEST EXTENT ALLOWED BY LAW, SENTIUM AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, DIGITAL ASSETS OR ITEM VALUE, HOWEVER CAUSED, EVEN IF ADVISED OF THEIR POSSIBILITY.

17.2. TO THE FULLEST EXTENT ALLOWED BY LAW, SENTIUM'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE GAME OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID SENTIUM FOR MINTS AND PURCHASES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, VALUED IN US DOLLARS AT THE TIME OF EACH PAYMENT, AND (B) US$50.

17.3. **Hacks and theft.** TO THE FULLEST EXTENT ALLOWED BY LAW, SENTIUM IS NOT LIABLE FOR ANY LOSS OF SOL, TOKENS, ITEMS OR OTHER ASSETS CAUSED BY HACKING, PHISHING, MALWARE, THEFT, UNAUTHORISED ACCESS TO YOUR DEVICE, WALLET, KEYS, TELEGRAM ACCOUNT OR BEATKING ACCOUNT, OR ANY ATTACK ON, OR FAILURE OF, THE GAME, ITS SERVERS, PRIVY, SOLANA, A WALLET APP, A MARKETPLACE OR ANY OTHER SERVICE, INCLUDING ASSETS IN A HOSTED WALLET. KEEP IN THE GAME ONLY WHAT YOU CAN AFFORD TO LOSE.

17.4. Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud, or for death or personal injury caused by negligence.

## 18. Indemnity

You will defend, indemnify and hold harmless Sentium and its officers, directors, employees, contractors and agents from any claim, loss, liability, damage, cost or expense (including reasonable legal fees) arising from your use of the Game, Your Content, your breach of these Terms or of any law, or your violation of anyone's rights.

## 19. Governing law

These Terms and any dispute relating to them or the Game are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules, and by the Federal Arbitration Act.

## 20. Disputes and arbitration

20.1. **Talk to us first.**

* (a) Before either side starts arbitration or a court claim, it must send the other a written notice of the dispute. You send yours to <support@beatking.win>. We send ours to the email or Telegram account linked to your account, or in the Game.
* (b) Your notice must give your name, your BEATKING username or wallet address, and how to contact you. It must also describe the claim and its facts, and state the relief and amount you want. You must sign it personally, even if a lawyer helps you; an electronic signature is fine. One notice covers one person only. Our notice to you gives the same kind of information.
* (c) For 60 days after a complete notice is received, we will both try to resolve the dispute informally. During that time either side may ask for one individual call by phone or video. You must attend personally, and your lawyer may join. We will send someone with authority to settle.
* (d) Neither side may start arbitration or a court claim until this period ends. From the day a complete notice is received until the period ends, all time limits for that claim are paused, including Section 20.9.
* (e) Following this Section 20.1 is a condition for starting any claim. If a claim is started without it, the arbitrator or court must dismiss it without prejudice.
* (f) Every arbitration demand must include the notice. If a lawyer files the demand, the lawyer must certify in it that the claimant personally signed the notice. The lawyer must also certify that they checked the claim to the standard of Federal Rule of Civil Procedure 11(b). The same applies to demands we file.

20.2. **Binding arbitration.**

* (a) If the dispute is not resolved under Section 20.1, you and Sentium agree to resolve it by final and binding individual arbitration, not in court. Section 20.6 lists the exceptions. "Dispute" means any dispute, claim or controversy between you and Sentium that relates to these Terms, the Privacy Policy, the Game, items, mints, purchases, the market or any communication between us. It covers claims in contract, tort, statute, fraud or any other basis. It covers claims that arose before you accepted these Terms. Our officers, directors, employees, contractors and agents may also enforce this Section for claims against them.
* (b) The arbitrator decides all disputes about the meaning, scope, formation, validity and enforceability of this arbitration agreement, including whether a dispute must be arbitrated. A court, not an arbitrator, decides: (i) whether Sections 20.4 and 20.11 are enforceable, and how they apply; (ii) whether Section 20.5(b) to (d) is enforceable; (iii) whether a claim seeks public injunctive relief under Section 20.4(c); and (iv) whether a claim falls under Section 20.6(c).

20.3. **Rules, place and fees.**

* (a) The American Arbitration Association (AAA) administers the arbitration under its Consumer Arbitration Rules, wherever you live, as changed by this Section. If the AAA passes a case to its International Centre for Dispute Resolution, the Consumer Arbitration Rules and the consumer fee schedule still apply. The rules are at adr.org.
* (b) If the AAA cannot or will not administer the arbitration, JAMS administers it under its applicable rules and its Consumer Minimum Standards. If JAMS cannot either, a court appoints the arbitrator under 9 U.S.C. § 5.
* (c) There is one arbitrator: a retired judge or a lawyer with at least 10 years of practice. The arbitration is in English. Its legal seat is Wilmington, Delaware, USA.
* (d) Hearings are by video or phone, or decided on written submissions where the rules allow. If the arbitrator decides that an in-person hearing is needed, it takes place in the US county where you live. If you live outside the US, the arbitrator decides where.
* (e) You pay no more than the filing fee that the AAA rules set for consumers. Sentium pays all other administration and arbitrator fees. If Sentium starts the arbitration, Sentium pays all of them.
* (f) Each side pays its own lawyers and costs. The arbitrator may award lawyers' fees and costs only where the law the claim is based on allows it. If the arbitrator finds that a claim or defence was frivolous or brought for an improper purpose, judged by the standard of Federal Rule of Civil Procedure 11(b), the arbitrator may order the side that brought it to pay the other side's fees and costs.
* (g) The arbitrator may award the same individual remedies that a court could award. The arbitrator applies these Terms, including Sections 16 and 17, as a court would, and gives a short written decision with reasons. Judgment on the award may be entered in any court that has jurisdiction.

20.4. **Individual claims only.**

* (a) You and Sentium may bring claims against each other only individually. Neither side may bring a claim as a plaintiff or class member in any class, collective, consolidated or representative proceeding, in arbitration or in court. Class arbitration is never allowed.
* (b) The arbitrator may award relief only to the individual claimant, and only as far as needed for that claimant's own claim. An award has no effect on any other dispute or any other person, except to enforce that award.
* (c) If a court decides, after all appeals, that the law does not let you waive a claim for public injunctive relief, that claim alone goes to court under Section 20.8. Public injunctive relief means relief whose main purpose is to stop unlawful acts that harm the general public. The court case is paused until the arbitration of all individual claims and remedies has finished.

20.5. **Mass filings.**

* (a) If 25 or more similar demands are filed against Sentium by, or with the help of, the same or coordinated lawyers or organisations, that is a "Mass Filing". In a Mass Filing, the AAA Mass Arbitration Supplementary Rules and their fee schedule also apply. Disputes about whether these rules apply, and how they work, are decided as those rules provide.
* (b) **Test cases.** The claimants' lawyers pick up to 10 cases and Sentium picks up to 10 cases. These go first, each before a different arbitrator. The other cases are held. While they are held, neither side owes administration or arbitrator fees for them, other than any filing fee the AAA rules require at filing, and their time limits stay paused. The result of a test case does not bind any other claimant.
* (c) **Mediation.** Within 30 days after the last test-case award, both sides mediate all remaining cases together for up to 60 days. The mediator is chosen under the AAA rules, and Sentium pays the mediator's fees.
* (d) **The rest.** If mediation does not resolve the remaining cases, they proceed together under the AAA Mass Arbitration Supplementary Rules. The same happens if the test cases are not all decided within 240 days after the other cases are held. Each claimant's claim is still decided individually.
* (e) If a court finds that Section 20.5(b) to (d) cannot be enforced for a Mass Filing, those parts do not apply to it. Its cases then proceed under the AAA Mass Arbitration Supplementary Rules alone. A Mass Filing never proceeds as a class arbitration.

20.6. **Exceptions.**

* (a) Either side may bring an individual claim in small claims court in the US county where you live or in Delaware, for as long as the claim stays there. Either side may choose small claims court instead of arbitration before an arbitrator is appointed.
* (b) Either side may bring a claim in court for infringement or misappropriation of its intellectual property rights, including your rights in Your Content. Either side may also ask a court for an injunction to stop unauthorised access to, or interference with, its systems, accounts or wallets.
* (c) If a claim falls under the US Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act, you may choose to bring it in court.
* (d) Either side may ask a court for temporary relief to keep things as they are until an arbitrator can rule.

20.7. **Opt out.** You can opt out of this arbitration agreement by emailing <support@beatking.win> within 30 days after you first accept these Terms. The email must give your name, your BEATKING username or wallet address, and a clear statement that you opt out of arbitration. Each person must opt out for themselves; no one can opt out for a group. Opting out does not affect any other part of these Terms, including Section 20.4 as far as the law allows.

20.8. **Courts.** Any dispute that is not arbitrated is heard only in the state or federal courts in Delaware, subject to Sections 20.6(a) and 20.10. You and Sentium consent to their jurisdiction. A request to compel arbitration, or to confirm, change or set aside an award, may be filed in any court that has jurisdiction. To the extent allowed by law, you and Sentium waive any right to a jury trial.

20.9. **Time limit.** To the extent allowed by law, a claim must be started by a notice under Section 20.1 within one year after the claimant knew, or should have known, of the facts behind it. Otherwise the claim is barred. This applies to both sides. If the law sets a longer period that a contract cannot shorten, that period applies. If this Section 20.9 cannot be enforced, only this Section is removed.

20.10. **Consumers in the EU, the UK and similar countries.** This Section 20.10 applies if you are a consumer who usually lives in the European Economic Area, the United Kingdom, Switzerland, or another country whose mandatory law gives consumers the right to sue in their local courts despite an earlier agreement, or makes an arbitration agreement made before a dispute non-binding on consumers. In that case, Sections 20.2 to 20.5 and 20.8 bind you only as far as that law allows. You may bring a claim in the courts of your country where that law gives you the right, and Sentium may bring claims against you there. You also keep the protections of your country's mandatory law, and Section 19 applies only as far as that law allows.

20.11. **If the class waiver fails.** If a court decides, after all appeals, that Section 20.4(a) cannot be enforced for a claim, that claim alone is heard in court under Section 20.8, never in arbitration, and the court case is paused until all individual claims in arbitration have finished. The rest of this Section 20 still applies.

20.12. **Severability.** If any other part of this Section 20 is found unenforceable, it is removed, and the rest of this Section is enforced, including arbitration of all remaining claims.

20.13. **Changes to this Section.** If Sentium makes a material change to this Section 20, you may reject it by emailing <support@beatking.win> within 30 days after the change takes effect. If you reject it, the last version of this Section that you accepted keeps applying to you. A change never applies to a dispute already notified under Section 20.1. This Section 20.13 overrides Section 21 for changes to Section 20.

20.14. **Survival.** This Section 20 survives the end of these Terms, the closing or deletion of your account, and the end of the Game.

## 21. Changes to these Terms

We may change these Terms at any time. We will post the new version with a new effective date and, for material changes, tell you in the Game or through the Telegram bot. The changes apply from the date shown. If you keep using the Game after that, you accept them. If you do not accept them, stop using the Game. Changes to Section 20 follow Section 20.13.

## 22. General

22.1. These Terms and the Privacy Policy are the entire agreement between you and Sentium about the Game.

22.2. If any part of these Terms is found unenforceable, it will be enforced as far as possible, and the rest stays in force.

22.3. Our failure to enforce a right is not a waiver of it.

22.4. You may not assign or transfer these Terms. Sentium may assign them, including in a merger, acquisition or sale of assets.

22.5. Sentium is not liable for any delay or failure caused by events beyond its reasonable control, including network or blockchain failures, outages of third-party services, security incidents, changes in law and acts of government.

22.6. We may send you notices in the Game, through the Telegram bot or by posting them in the Docs. You agree to receive notices and these Terms electronically.

22.7. These Terms are written in English. Any translation is for convenience only.

22.8. Nothing in these Terms creates a partnership, joint venture, employment or agency relationship.

## Querying This Documentation
If you need additional information that is not directly available in this page, you can query the documentation by asking a question.

Perform an HTTP GET request on the following URL with the `ask` and `goal` query parameters:

```
GET https://beatking.gitbook.io/beatking-docs/legal/terms.md?ask=<question>&goal=<user_goal>
```

`ask` is the immediate question: it should be specific, self-contained, and written in natural language.
`goal` is what the user is ultimately trying to achieve, the reason they need the answer. Sharing it helps GitBook give you a better, more relevant answer. A goal is most helpful when it describes the outcome the user wants rather than restating the question. For example, with `ask=how do I create an API token`, a goal like `automate deployments from our CI pipeline` lets GitBook tailor the answer to that use case.

The response will contain a direct answer to the question and relevant excerpts and sources from the documentation.

Use this mechanism when the answer is not explicitly present in the current page, you need clarification or additional context, or you want to retrieve related documentation sections.
